These Policies, Terms & Conditions govern the use of the Total Diamond Tools website and the purchase of products from Total Diamond Tools. By accessing this website, requesting a quotation, submitting an order, or purchasing products from Total Diamond Tools, you agree to the following terms and conditions.

All orders and sales by Total Diamond Tools are subject to these Terms and Conditions unless otherwise agreed to in writing by Total Diamond Tools.

Any additional or different terms contained in a customer purchase order or other document will not modify these Terms and Conditions unless expressly accepted in writing by Total Diamond Tools.

Total Diamond Tools reserves the right to update or modify these Terms and Conditions at any time. The terms applicable to an order are those in effect when the order is accepted, unless otherwise agreed in writing.

Product descriptions, specifications, availability, and prices are subject to change without notice.

Total Diamond Tools makes reasonable efforts to ensure that product information and pricing are accurate. However, errors may occasionally occur. We reserve the right to correct typographical, pricing, specification, or other errors and to cancel or refuse an order affected by an error.

A quotation does not constitute acceptance of an order unless otherwise stated in writing. Orders are subject to acceptance and product availability.

Unless otherwise stated, quotations are valid for the period specified on the quotation.

All prices are stated in U.S. Dollars unless otherwise indicated. Applicable taxes, shipping, freight, handling, and other charges may be additional.

Payment is due according to the terms stated on the applicable quotation, sales order, invoice, or customer account agreement.

Total Diamond Tools may accept credit cards and other approved forms of payment.

Customers with approved credit accounts are responsible for payment according to their established account terms.

Total Diamond Tools reserves the right to require payment before shipment, suspend shipments, or modify credit terms when an account is past due or when circumstances reasonably warrant such action.

Customers are responsible for any lawful costs associated with collecting past-due balances.

Applicable sales tax, use tax, or other taxes will be charged where required by law.

Customers claiming tax-exempt status are responsible for providing Total Diamond Tools with valid and current exemption documentation before an order is processed as tax exempt.

Total Diamond Tools may offer the following shipping and delivery methods:

  • UPS Ground
  • UPS Next Day Air
  • Other approved carrier services when required
  • Will Call / Customer Pickup
  • Our Truck / Local Delivery where available

Available shipping methods may depend on the product, order size, destination, and customer requirements.

Unless otherwise agreed in writing, shipping and freight charges are the responsibility of the customer.

Freight may be quoted separately, added to the sales order or invoice, or calculated based on the applicable shipping method.

When Total Diamond Tools agrees to absorb or prepay freight, this will be specifically stated on the applicable quotation, sales order, or invoice.

Oversized, overweight, palletized, or special-handling shipments may require additional freight charges.

Shipping and delivery dates are estimates unless Total Diamond Tools expressly guarantees a delivery date in writing.

Total Diamond Tools is not responsible for carrier delays, weather delays, transportation interruptions, supply-chain disruptions, or other circumstances outside our reasonable control.

Unless otherwise agreed in writing, risk of loss transfers according to the applicable shipping arrangement and governing law.

Customers should inspect shipments promptly upon receipt.

Customers should inspect all shipments immediately upon delivery.

Visible damage, shortages, or missing packages should be noted with the carrier at the time of delivery whenever possible and reported promptly to Total Diamond Tools.

Customers should retain the original packaging, shipping materials, and damaged products while a freight claim is being investigated.

Total Diamond Tools will reasonably assist customers with carrier claims when appropriate.

Products may not be returned without prior authorization from Total Diamond Tools.

Customers must contact Total Diamond Tools to obtain a Return Merchandise Authorization (RMA) and return instructions before returning any product.

Unauthorized returns may be refused or returned to the sender.

Eligible products may be returned within 30 days of the original invoice date, subject to prior authorization and the conditions stated in this Return Goods Policy.

To be eligible for return, products must be:

  • Unused
  • Unaltered
  • In new and resalable condition
  • In the original packaging, when applicable
  • Accompanied by the applicable RMA information and proof of purchase

All returns are subject to inspection and approval by Total Diamond Tools.

Approved non-warranty returns are subject to a 15% restocking fee.

The restocking fee will be deducted from the amount credited or refunded to the customer.

Original shipping, freight, and handling charges are non-refundable unless the return resulted from an error by Total Diamond Tools or otherwise required by applicable law.

Unless otherwise approved in writing by Total Diamond Tools, the following products are not eligible for return:

  • Products returned more than 30 days after the original invoice date
  • Used products
  • Installed or altered products
  • Products damaged after delivery
  • Custom-manufactured products
  • Special-order products
  • Products manufactured or modified to customer specifications
  • Products specifically identified as non-returnable at the time of sale

Diamond blades, core bits, grinding tools, and similar products that have been used are not returnable simply because they are unsuitable for a particular application when the product itself is not defective.

Claims involving an alleged product defect will be handled under the applicable manufacturer’s warranty process.

Unless the return results from an error by Total Diamond Tools or qualifies as an approved warranty claim, the customer is responsible for all return shipping costs.

Products must be securely packaged to prevent damage during transportation.

The RMA number, when provided, should be clearly identified with the return shipment.

Approved returns will be inspected before a refund or account credit is issued.

Eligible refunds or credits will be based on the approved returned merchandise amount, less the applicable 15% restocking fee and any other authorized charges.

Original shipping, freight, and handling charges are non-refundable unless otherwise approved.

Refunds or credits will be processed after the returned merchandise has been received, inspected, and approved.

Products sold by Total Diamond Tools are covered by the applicable manufacturer’s warranty against defects in materials and/or workmanship, where such a warranty is provided by the manufacturer.

The specific warranty period, coverage, limitations, exclusions, and remedies may vary by manufacturer and product.

Total Diamond Tools does not extend or modify a manufacturer’s warranty unless expressly stated in writing.

Customers who believe a product is defective should contact Total Diamond Tools before returning the product.

A warranty claim may require:

  • Proof of purchase
  • Product identification or part number
  • Photographs of the product
  • Description of the alleged defect
  • Information regarding the machine and application in which the product was used
  • Return of the product for inspection, when requested

Total Diamond Tools may assist in submitting or processing a warranty claim with the applicable manufacturer.

Final warranty determination and available remedies are subject to the applicable manufacturer’s warranty terms.

Depending on the manufacturer’s determination, an approved remedy may include repair, replacement, credit, or another remedy provided under the manufacturer’s warranty.

Manufacturer warranties generally do not cover damage or failure caused by conditions unrelated to a manufacturing defect, which may include:

  • Normal wear and tear
  • Misuse or abuse
  • Improper installation or mounting
  • Incorrect product selection or application
  • Improper operating speed or RPM
  • Inadequate cooling or water flow where required
  • Use with incompatible or defective equipment
  • Operator error
  • Accidents or impact damage
  • Unauthorized modification
  • Failure to follow applicable manufacturer instructions or safety requirements

Warranty coverage is determined according to the applicable manufacturer’s warranty terms.

Diamond blades, core bits, grinding tools, and related products can cause serious injury or property damage if selected, installed, or operated improperly.

Customers and operators are responsible for:

  • Selecting the correct product for the material and application
  • Confirming compatibility with the machine or equipment being used
  • Observing all maximum RPM and operating limitations
  • Properly mounting and inspecting products before use
  • Using appropriate guards and safety equipment
  • Wearing required personal protective equipment
  • Following machine, tool, and product manufacturer instructions
  • Complying with applicable workplace safety requirements

Never use a damaged, cracked, improperly mounted, or otherwise unsafe diamond tool.

The purchaser is responsible for ensuring that operators are properly trained and that products are used safely and for their intended applications.

These Terms and Conditions will be governed by and interpreted according to the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable federal law controls.
